AND LIMITED WARRANTY

1. CHEFETZ LLC dba MSProjectExperts, and its Affiliates (hereinafter called “CHEFETZ”) makes no warranties, express or implied, regarding the Website (for the purpose of these provisions, the term “Website” collectively refers to the websites www.msprojectexperts.com and www.projectdaddy.com and any other related websites, and all information contained therein, and all printouts generated from those websites). CHEFETZ does not warrant, guarantee or make any representations regarding the use or the results of the use of the Website in terms of its correctness, accuracy, reliability, or otherwise. The Website is provided "AS IS" and without warranty of any kind, and CHEFETZ expressly disclaims all warranties, express or implied, including without limitation the implied warranties of merchantability and fitness for a particular purpose. CHEFETZ does not warrant that the functions contained in the Website will meet any user’s requirements, or that the operation of the Website will be uninterrupted or error-free, or that defects in the Website will be corrected. No oral or written information or advice given by CHEFETZ or a CHEFETZ authorized representative shall create a warranty or in any way increase the scope of this warranty. The exclusion of implied warranties is not permitted in some states, and therefore the exclusion of implied warranties may not apply to some users.
2. You expressly acknowledge and agree that use of the Website is at your sole risk. CHEFETZ has policies and procedures to help prevent the spread of computer viruses and the like but does not warrant and does not accept liability for the spread of any virus and the like via its Website. The entire risk as to the results and performance of the Website is assumed by you. Should the Website prove defective, you (and not CHEFETZ or a CHEFETZ authorized representative) assume the entire cost of all necessary servicing, repair or correction. The exclusion of implied warranties is not permitted in some states, and therefore the exclusion of implied warranties may not apply to you.
3. Under no circumstances, including negligence, shall CHEFETZ or any of its directors, officers, employees or agents be liable for any incidental, special, consequential, or indirect damages resulting from the use or inability to use the Website, even if CHEFETZ or a CHEFETZ authorized representative have been advised of the possibility of such damages. Because some states do not allow exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In no event shall CHEFETZ's total liability to any user or class of users for all damages, losses, and causes of action (whether in contract, tort (including negligence) or otherwise) exceed $50.
4. The Website contains copyrighted material, trade secrets and other proprietary material; to protect them, you may not decompile, reverse engineer, disassemble or otherwise reduce the Website code to a human-perceivable form. You may not modify, network, rent, lease, loan, distribute or create derivative works based upon the Website, in whole or in part. You may not copy, duplicate, disclose, sell, transmit, or distribute the Website or its printouts in any manner whatsoever.
